Terms & Conditions of Use
1. Acceptance of Terms
By downloading, installing or using EmotionsMap, you accept these Terms and Conditions. If you do not agree, do not use the app.
2. License of Use
You are granted a limited, non-exclusive, non-transferable and revocable license to use EmotionsMap for personal, non-commercial use, in accordance with these terms.
You may not:
- Copy, modify or create derivative works of the app.
- Reverse engineer, decompile or disassemble the app.
- Sell, rent, lease or sublicense the app.
- Use the app for illegal or unauthorized purposes.
- Attempt to access systems or networks without authorization.
3. User Account
To use certain features, you must create an account. You are responsible for:
- Maintaining the confidentiality of your password.
- All activity under your account.
- Notifying us immediately of any unauthorized use.
You must provide accurate and current information. You may not:
- Create more than one personal account.
- Create an account using false information.
- Create an account if we have previously suspended or banned you.
4. Appropriate Use
EmotionsMap is a personal wellbeing tracking tool and does not replace professional medical, psychological or therapeutic advice, diagnosis or treatment.
- EmotionsMap does not provide medical, psychological or therapeutic counseling.
- You should not rely solely on the app for decisions about your mental health.
- If you experience a mental health crisis, contact emergency services or mental health professionals immediately.
- The app is for self-tracking and personal reflection only.
Medical disclaimer
If you have or suspect you have a mental health condition, consult a qualified healthcare professional. In emergencies, call your local emergency services or a mental health crisis line.
5. User Content
You are solely responsible for the content you create in the app, including mood entries and comments. By using the app you declare that:
- You own or have the necessary rights to the content.
- The content does not violate third-party rights.
- The content does not contain illegal, offensive or harmful material.
Ownership of content
You retain all rights to the content you create. We do not claim ownership over your mood records or comments.
6. Advertising
By using the app you accept that ads will be displayed in certain screens. We do not endorse, sponsor or guarantee the products or services advertised. Any interaction with advertised content is at your own risk and subject to the third party's terms.
7. Intellectual Property
EmotionsMap, including its design, source code, logos, graphics and all in-app content (except User Content), is the property of Héctor Veitía and is protected by intellectual property laws. All trademarks, service marks and trade names are the property of their respective owners.
8. Service Availability
We make our best effort to keep EmotionsMap available, but we do not warrant that:
- The app will always be available or operate without interruptions.
- It will be free of errors.
- Defects will be fixed within a specific time frame.
- The servers will be free of viruses or harmful components.
We reserve the right to modify or discontinue the app, perform scheduled or unscheduled maintenance, and update features and functionality.
9. Fees and Payments
EmotionsMap is currently free to download and use, supported by advertising. If paid features are introduced in the future:
- You will be notified in advance.
- Purchases will be optional.
- Prices will be displayed clearly.
- Payments will be processed through Apple App Store or Google Play Store.
10. App Updates
We may publish updates to add features, fix bugs, improve performance, strengthen security, or comply with legal or technical requirements. Some updates may be required to keep using certain services.
11. Termination
You can stop using EmotionsMap at any time by deleting your account from settings or uninstalling the app.
We may suspend or terminate your access if you:
- Violate these terms.
- Use the app fraudulently or illegally.
- Pose a security risk.
Upon termination:
- Access ceases immediately.
- Data stored in Firebase servers is removed.
- Local data remains on your device until you uninstall the app.
12. Limitation of Liability
EmotionsMap is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement of third-party rights, or accuracy.
We are not responsible for:
- Direct or indirect damages.
- Data loss.
- Decisions made based on the app.
- Mental health issues that have not been properly addressed.
- Errors, interruptions or loss of information.
- Unauthorized account use.
- Interaction with third-party services.
Maximum liability shall not exceed the amount paid for the app in the last twelve months (currently zero).
13. Indemnification
You agree to indemnify and hold harmless Héctor Veitía, his employees and affiliates from any claim or expense arising from your use of EmotionsMap, your violation of these terms, your violation of third-party rights, or content posted by you.
14. Dispute Resolution
These terms are governed by the laws of Ecuador. Any dispute will be resolved in the courts of Ecuador. Before initiating legal action, an informal resolution will be attempted by contacting us by email.
15. General Provisions
- If any provision is invalid, the rest shall remain in force.
- Failure to exercise a right does not constitute a waiver.
- These terms constitute the entire agreement.
- You may not assign them without prior consent.
- Provisions that should survive will continue in effect after termination.
16. Changes to the Terms
We reserve the right to modify these terms. Notice will be given via in-app, email or by updating the effective date. Continued use implies acceptance of the changes.
17. Health and Wellbeing Notice
EmotionsMap is a personal tracking tool and is not a medical device, diagnosis tool or treatment.
- It does not provide diagnoses or replace professional care.
- It must not be used in emergency situations.
- If you are in crisis, contact your local emergency services or a mental health hotline.
Recommendations
- Use EmotionsMap as a complement, not a replacement for professional care.
- Consult a professional if you have persistent symptoms.
- The app is only for self-knowledge and personal tracking.

Términos y Condiciones de Uso
1. Aceptación de los Términos
Al descargar, instalar o usar EmotionsMap, aceptas estos Términos y Condiciones. Si no estás de acuerdo, no uses la aplicación.
2. Licencia de Uso
Se te concede una licencia limitada, no exclusiva, no transferible y revocable para usar EmotionsMap para tu uso personal y no comercial, conforme a estos términos.
No puedes:
- Copiar, modificar o crear obras derivadas de la aplicación.
- Realizar ingeniería inversa, descompilar o desensamblar la aplicación.
- Vender, alquilar, arrendar o sublicenciar la aplicación.
- Usar la aplicación para fines ilegales o no autorizados.
- Intentar acceder a sistemas o redes no autorizadas.
3. Cuenta de Usuario
Para usar ciertas funciones debes crear una cuenta. Eres responsable de:
- Mantener la confidencialidad de tu contraseña.
- Toda actividad que ocurra bajo tu cuenta.
- Notificarnos de inmediato cualquier uso no autorizado.
Debes proporcionar información precisa y actualizada. No puedes:
- Crear más de una cuenta personal.
- Crear una cuenta con información falsa.
- Crear una cuenta si te hemos suspendido o baneado previamente.
4. Uso Apropiado
EmotionsMap es una herramienta de seguimiento del bienestar personal y no sustituye el consejo, diagnóstico ni tratamiento médico, psicológico o terapéutico profesional.
- EmotionsMap no proporciona asesoramiento médico, psicológico ni terapéutico.
- No debes confiar únicamente en la aplicación para decisiones sobre tu salud mental.
- Si experimentas una crisis, contacta de inmediato a servicios de emergencia o profesionales de salud mental.
- La aplicación es solo para auto-seguimiento y reflexión personal.
Descargo de responsabilidad médica
Si tienes o sospechas que tienes un problema de salud mental, consulta a un profesional calificado. En emergencias, llama a los servicios de emergencia locales o a una línea de crisis.
5. Contenido del Usuario
Eres el único responsable del contenido que creas en la aplicación, incluidos registros de ánimo y comentarios. Al usar la aplicación declaras que:
- Eres dueño o tienes los derechos necesarios sobre el contenido.
- El contenido no viola derechos de terceros.
- El contenido no contiene material ilegal, ofensivo o perjudicial.
Propiedad del contenido
Conservas todos los derechos sobre el contenido que creas. No reclamamos propiedad sobre tus registros de ánimo ni comentarios.
6. Publicidad
Al usar la aplicación aceptas que se mostrarán anuncios en ciertas pantallas. No respaldamos, patrocinamos ni garantizamos los productos o servicios anunciados. Cualquier interacción con contenido publicitario es bajo tu propio riesgo y se rige por los términos del tercero.
7. Propiedad Intelectual
EmotionsMap, incluyendo su diseño, código fuente, logotipos, gráficos y todo el contenido de la aplicación (excepto el contenido del usuario), es propiedad de Héctor Veitía y está protegido por leyes de propiedad intelectual. Todas las marcas comerciales, marcas de servicio y nombres comerciales son propiedad de sus respectivos dueños.
8. Disponibilidad del Servicio
Hacemos nuestro mejor esfuerzo por mantener EmotionsMap disponible, pero no garantizamos que:
- La aplicación esté siempre disponible o funcione sin interrupciones.
- Esté libre de errores.
- Los defectos se corrijan en un plazo determinado.
- Los servidores estén libres de virus u otros componentes dañinos.
Nos reservamos el derecho de modificar o discontinuar la aplicación, realizar mantenimiento programado o no programado, y actualizar características y funcionalidades.
9. Tarifas y Pagos
EmotionsMap es actualmente gratuita para descargar y usar, sostenida con publicidad. Si en el futuro se introducen funciones de pago:
- Se notificará con anticipación.
- Las compras serán opcionales.
- Los precios se mostrarán claramente.
- Los pagos se procesarán a través de Apple App Store o Google Play Store.
10. Actualizaciones
Podemos publicar actualizaciones para añadir funciones, corregir errores, mejorar el rendimiento, reforzar la seguridad o cumplir requisitos legales o técnicos. Algunas actualizaciones pueden ser obligatorias para continuar usando ciertos servicios.
11. Terminación
Puedes dejar de usar EmotionsMap en cualquier momento eliminando tu cuenta desde la configuración o desinstalando la aplicación.
Podemos suspender o terminar tu acceso si:
- Violas estos términos.
- Usas la aplicación de manera fraudulenta o ilegal.
- Representas un riesgo de seguridad.
Al terminar la cuenta:
- El acceso cesará inmediatamente.
- Los datos almacenados en servidores de Firebase se eliminarán.
- Los datos locales permanecerán en tu dispositivo hasta que desinstales la aplicación.
12. Limitación de Responsabilidad
EmotionsMap se proporciona "tal cual" y "según disponibilidad", sin garantías de ningún tipo, expresas o implícitas, incluyendo comerciabilidad, idoneidad para un propósito particular, no violación de derechos de terceros o precisión.
No somos responsables por:
- Daños directos o indirectos.
- Pérdida de datos.
- Decisiones tomadas basándose en la aplicación.
- Problemas de salud mental no tratados adecuadamente.
- Errores, interrupciones o pérdida de información.
- Uso no autorizado de la cuenta.
- Interacción con servicios de terceros.
La responsabilidad máxima no excederá la cantidad pagada por la aplicación en los últimos doce meses (actualmente cero).
13. Indemnización
Aceptas indemnizar y eximir de responsabilidad a Héctor Veitía, sus empleados y afiliados por cualquier reclamación o gasto derivado de tu uso de EmotionsMap, violación de estos términos, violación de derechos de terceros o contenido publicado por ti.
14. Resolución de Disputas
Estos términos se rigen por las leyes de Ecuador. Cualquier disputa se resolverá en los tribunales de Ecuador. Antes de iniciar acciones legales, se intentará una resolución informal contactándonos por correo electrónico.
15. Disposiciones Generales
- Si alguna disposición es inválida, las demás seguirán en vigor.
- La falta de ejercicio de un derecho no constituye renuncia.
- Estos términos constituyen el acuerdo completo.
- No puedes cederlos sin consentimiento previo.
- Las disposiciones que deban sobrevivir continuarán vigentes tras la terminación.
16. Cambios a los Términos
Nos reservamos el derecho de modificar estos términos. Se notificará mediante la aplicación, correo electrónico o actualización de la fecha de vigencia. El uso continuado implica aceptación de los cambios.
17. Información de Salud y Bienestar
EmotionsMap es una herramienta de seguimiento personal y no es un dispositivo médico, una herramienta de diagnóstico o tratamiento.
- No proporciona diagnósticos ni sustituye atención profesional.
- No debe usarse en situaciones de emergencia.
- Si estás en crisis, contacta a los servicios de emergencia locales o a una línea de salud mental de tu país.
Recomendaciones
- Usa EmotionsMap como complemento, no como reemplazo de la atención profesional.
- Consulta a un profesional si presentas síntomas persistentes.
- La aplicación es solo para autoconocimiento y seguimiento personal.
